These General Terms and Conditions (hereinafter Terms) apply to all orders placed through the website ey-lo.com with EY-LO Eyes for your Loupes UG (haftungsbeschränkt), Feurigstraße 56, 10827 Berlin, Germany (hereinafter EY-LO). They apply to both consumers within the meaning of Section 13 of the German Civil Code (BGB) and to business customers within the meaning of Section 14 BGB. Deviating terms of the customer shall not be recognised unless EY-LO expressly agrees to their application in writing.
The purchase contract is concluded with EY-LO Eyes for your Loupes UG (haftungsbeschränkt), Feurigstraße 56, 10827 Berlin, Germany, represented by the managing director Max Scholz. Contact by email at info@ey-lo.com.
The presentation of products on the website does not constitute a legally binding offer, but rather an invitation to the customer to submit an offer. By submitting the order form on the website, the customer makes a binding offer to conclude a purchase contract. EY-LO will confirm receipt of the order without delay by email. This confirmation of receipt does not constitute acceptance of the offer. The contract is only concluded when EY-LO accepts the order through an explicit order confirmation or by sending the invoice. The contract language is English or German. The contract text will be stored by EY-LO and sent to the customer together with the invoice by email.
All prices stated on the website are final prices including the applicable value added tax. Within Germany and the European Union, shipping is included in the purchase price. For deliveries to countries outside the European Union, shipping costs are calculated individually and shown on the invoice. Any customs duties and import taxes in the country of destination are borne by the customer and are not included in the purchase price.
Payment is made in advance by bank transfer to the account stated on the invoice. The payment term is, unless otherwise stated on the invoice, 30 days from the invoice date. The invoice number must be given as the payment reference. Shipment of the goods takes place only after receipt of full payment.
Delivery is made to the delivery address provided by the customer. Within Germany and the European Union, shipment is generally made via DHL. For deliveries to countries outside the European Union, DHL Express is used. The estimated delivery time is stated on the invoice as the delivery date. Delays due to production bottlenecks will be communicated to the customer by EY-LO without delay.
The delivered goods remain the property of EY-LO until the purchase price has been paid in full.
Consumers are entitled to a statutory right of withdrawal of 14 days. On a voluntary basis, EY-LO also grants this right of withdrawal to business customers and to customers from countries outside the European Union, so that all orders worldwide can be withdrawn within 14 days without giving any reason. Details on the exercise of the right of withdrawal, on the periods and on the consequences of withdrawal can be found in our Withdrawal Policy. The costs of the return shipment are borne by the customer.
For all purchase contracts, the statutory liability for defects under Sections 434 et seq. BGB applies with a warranty period of two years from delivery of the goods. This period applies both to consumers and to business customers. If the delivered goods show a defect, the customer may first demand subsequent performance in the form of replacement delivery or repair. If subsequent performance fails, the customer is entitled to the statutory right of withdrawal from the contract or reduction of the purchase price.
In addition to the statutory warranty, EY-LO grants a manufacturer's guarantee of 12 months on the EY-LO Dual Camera System from delivery of the goods. The guarantee covers the functionality of the camera unit and all components included in the scope of delivery, when used as intended. If a defect occurs within the guarantee period, EY-LO will replace the defective product at its own discretion by repair or exchange. The guarantee does not cover damage caused by improper use, drops, mechanical impact, or contact with liquids beyond the intended cleaning. The statutory warranty rights of the customer remain unaffected by this guarantee.
EY-LO is liable without limitation in the case of intent and gross negligence, as well as in the case of injury to life, body, or health. In cases of slight negligence, EY-LO is only liable for the breach of essential contractual obligations, the fulfilment of which is necessary for the proper performance of the contract and on the observance of which the customer may regularly rely. In this case, liability is limited to the foreseeable damage typical for the contract. Liability under the German Product Liability Act (Produkthaftungsgesetz) remains unaffected.
The collection, processing and use of personal data takes place exclusively within the framework of the applicable legal provisions, in particular the General Data Protection Regulation. Details can be found in our Privacy Policy.
The European Commission provides a platform for online dispute resolution, which can be found at https://ec.europa.eu/consumers/odr. EY-LO is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
The law of the Federal Republic of Germany applies to the exclusion of the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that the protection granted by mandatory provisions of the law of the state of the consumer's habitual residence is not withdrawn. Place of jurisdiction for all disputes arising from or in connection with contracts with business customers is Berlin, Germany. Should individual provisions of these Terms be wholly or partially invalid, the validity of the remaining provisions shall not be affected.
Note: These Terms will be adapted and supplemented with further provisions as soon as EY-LO has completed its tax registration and the entry in the commercial register has been finalised.
